Terms of service
These Terms of service ("Terms") are an agreement between you and ColdCampers Inc ("we", "us") for the use of IVRC, a hosted business phone service available at ivrc.hostingsip.com. By creating an account or using the service you agree to these Terms. If you accept them for a business, you confirm that you may bind that business. Effective September 30, 2026.
1. The service
IVRC gives your business a phone number, an automated phone menu, extensions, call forwarding, voicemail and the other features of the plan you choose, managed through an online portal. Features differ by plan; the pricing page lists what each plan includes.
2. Your account
You must give accurate information and keep your sign-in details secret. You are responsible for everything done through your account, including by the people you invite. Tell us at obaid@obaid.ca straight away if you think your account has been used without permission.
3. Your phone number
Each account receives one business phone number. Numbers are provided through our telephone carriers and remain assigned to your account while it is active. A number may be reclaimed after your account is cancelled, after which it may be given to another customer.
4. Emergency calls (911)
IVRC is an internet-based business phone system, not a traditional telephone service. Emergency (911) calling is severely restricted and may not work during power, internet or service outages, or if your address isn't registered. Always keep another way to call 911, such as a mobile phone.
Emergency calling (911) is available on eligible Canadian and US lines where the phone company supports it on the line, once your emergency address has been registered and your account shows it as Ready. It is not guaranteed.
Internet-based (VoIP) emergency calling has limitations compared with traditional telephone service. Power, Internet, network, equipment or provider outages can interrupt or delay it, and a call may not show the right location if the address on file is not current. When you call 911 you may need to tell the operator your location and callback number. Keep another way to call emergency services, such as a mobile phone.
Your responsibility. When you set up your service you must set its emergency (911) address, including the address of each phone used at another location, such as a phone a worker uses at home or at another office. Keeping every one of these addresses accurate and current is your legal responsibility, and you must update an address before you move a phone or device. A 911 call shows the address you registered. You must tell everyone who uses your phones, including your workers, about these limitations. Our Emergency calling (911) notice explains this in more detail.
Outside calling and emergency registration. You can dial 911 from your phones at any time, including before your emergency address is confirmed. Calls to other outside numbers are turned on only after the emergency (911) address of your number has been registered and confirmed by the phone company (your account shows it as Ready) and, for a phone used at another location, after that phone's address has been entered in your account. Until then a 911 call still connects, but emergency services may not receive your address. A 911 call shows a business number whose emergency address is registered, which may not be the number shown on your other calls. You must keep the address of every number and of every phone used at another location accurate and current, and tell everyone who uses your phones about these rules.
Emergency service fees and charges. The emergency (911) service on each of your numbers has a one-time setup fee and a monthly fee, which are charged to you with the number. If the phone company charges us for an emergency call made from your service while your emergency (911) registration was not complete (for example a per-call fee), that charge is passed on to you and added to your next invoice.
Limits of our responsibility for 911. To the extent the law allows, ColdCampers Inc is not liable for any failure, delay or misdirection of a 911 call caused by an inaccurate, out-of-date or missing address, by a power, Internet, network, equipment or provider outage, or by your not completing or not keeping current your emergency (911) registration.
Your indemnity for 911. You will indemnify and hold ColdCampers Inc harmless from any claim, damage, fine, cost or charge (including a phone company's charge) arising from the use of 911 by you or by anyone using your phones, from an inaccurate, out-of-date or missing emergency address, or from your not informing your users of these limitations.
Notice and your consent. Our Emergency calling (911) notice is shown to you when you set up your service and is always available at ivrc.hostingsip.com/legal/emergency-911. Your service starts only after you have expressly accepted it; your account keeps a record of that acceptance.
5. Recording, voicemail and your callers
If you use call recording, voicemail or transcripts, you are responsible for telling your callers and for getting any consent the law requires where you and your callers are located. The laws of some places require every party to agree before a call is recorded. We process your callers' information on your behalf and only to provide the service to you.
6. Acceptable use
You must not use the service to break the law, to harass anyone, to send unsolicited or automated marketing calls, to impersonate anyone, to interfere with the service or other customers, or to try to get around its security or limits. We may suspend a number or an account that is being misused.
7. Plans, prices and payment
Plans are billed monthly in advance through Stripe, which handles your card details; we do not store card numbers. Prices are shown before you buy and do not include taxes unless stated. We will give you 30 days notice before a price change applies to you. If your plan includes a free trial, you will not be charged until the trial ends. You can cancel before then at no cost.
If a payment fails, your service continues for 7 days while you update your payment method. After that we may suspend the service until the balance is paid. We do not delete your data because of a failed payment.
8. Cancellation and refunds
You can cancel at any time from your account. Cancellation takes effect at the end of the current billing period, and your service continues until then.
Fees already paid are not refundable, except where the law requires a refund.
After cancellation your account data is deleted when you ask us to. Download anything you want to keep before you ask.
9. Availability and changes
We work to keep the service available but do not promise that it will be uninterrupted or error free. Calls depend on telephone carriers and internet connections that we do not control. We may change or improve features; if a change removes something material from your plan, we will tell you in advance.
10. Your content and our software
You own the content you add, such as greetings, menus, recordings and contact details, and you allow us to use it only to provide the service. IVRC, its software and its design are proprietary to ColdCampers Inc. You may not copy, resell, reverse engineer or build a competing service from it.
11. Privacy
Our Privacy policy explains what we collect and how we use it.
12. Limitation of liability
To the extent the law allows, ColdCampers Inc is not liable for indirect or consequential losses, such as lost profits, lost business or missed calls, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You will cover our reasonable costs of a claim brought against us because of how you or your users used the service in breach of these Terms or the law, including recording calls without the consent the law requires.
14. Suspension and termination
We may suspend or end your account if you seriously or repeatedly break these Terms, do not pay, or if the law requires it. Where we reasonably can, we will warn you first.
15. Changes to these Terms
We may update these Terms. We will give you 30 days notice of a material change by email or in the portal. Continuing to use the service after that means you accept the new Terms.
16. Governing law
These Terms are governed by the laws of Ontario, Canada. Any dispute will be decided by the courts of Ontario, Canada, unless the law where you live gives you the right to bring it elsewhere.
